Q: My daughter is a single parent in Florida whom receives child support from biological father who lives in new York.

She is wanting to give us her parents temporary custody of her son. Does the biological father need to sign petition forms? Our grandchild has been in our custody or living in or home the majority of his life 3 years.

A: You can file a petition for temporary custody by extended family, but you need the father's consent. If you do not have his consent, then you have to prove by clear and convincing evidence that he is unfit. The best thing for you to do is to go talk to a family lawyer in your area about this.
