Orange Park, FL asked in Family Law for Florida

Q: On average how long would it take to get into court on a child custody case? And Where can i find child custody papers?

My dayghter has always wanted to live with me(her mom). My daughter is a sophmore in high school and she wants to go to college where i live, in Michigan. But in order to avoid out of state fees you have to live in the state for about a year. But she wants to move as soon as possible and always has, but my ex husband is not cooperative at all which is why it hasnt been done sooner for he has claims of delaying dates and dragging it out, not responding to emails or calls of mine with concern of my child. Now the time is really running low to avoid out of state fees and just to get her here in general. But this is where she wants to be is living with me. So about how long on average does it take to get into a court room or set a date and all that and such. She doesnt want to live with her father. Any time she talks with her father about it (always) it does not end well and it ends in arguing and her father has no reason for her not to live with me. Please help.

Sincerly,

The daughter

A: The mother needs to ask more questions than this, to an attorney, face to face, for a full discussion. The choice of the child is only one of many factors, and if there is no substantial change in circumstances since the final judgment, she the mother will lose. So, it does not matter how long it would take to get into court for a hearing.
