Asked in Family Law for Florida

Q: Can my baby's father keep my child (who is only 2 y.o.) during a visit, and not return her to me?

We are separated since Feb 2015. I live in FL with my mom, he lives in GA with his sister. He asked to see his daughter for Thanksgiving holiday. He says he will return her in 3 days, I am scared he will try to keep her since he has not seen her in almost 6 months. Should I let her go with him, or ask him to come see her in Florida. I am afraid he will try to keep her and then say I gave her up. He was physically and verbally abusive to me during our marriage. He threatens me over the phone and via text all the time, but I don't want to keep his child from him.

A: What you need to do is go have a full discussion with a family attorney about all of this. You are married, right? Where did you last reside together as husband and wife? That is important, very important, because that is probably where you have to file any sort of case.
