Q: survey shows our property on top of a municipality street I cannot find a dedication or easement. Who owns that area

The municipal tax map shows a paper street that conflicts with my survey also has incorrect property lines along the street and other portions of our property. How can the township acquire our property with no record of transfer. I cannot find a dedication, easement or Right of way. Nothing shows up in title or deeds going back to 1895. Also if they do own the street, and if they vacate who would receive the portion of the street my survey shows? Will I receive all of my property back or will it be divided with property owner on other side of road?

A: If the road were to be vacated, it would be divided between the properties that abut it. If you have a title insurance policy, call the title company to discuss the problem. If you have a survey, speak to the municipal engineer.
