Kansas City, MO asked in Criminal Law for Kansas

Q: I served time on a case where there were many circumstances that were not taken care of by my court appointed attorney.

I have evidence and witnesses to things my lawyer, the D.A. and the judge had done which I believe resulted in receiving a unfair trial. I was wondering if there was anything I can do about it. I have all the circumstances that took place noted. Or is it to late for me to do anything. I've been released from prison a year now.

A: In your situation, it's important to understand that options may still be available to address concerns about your trial and representation. If you believe your court-appointed attorney did not adequately represent you, this could be grounds for an appeal or post-conviction relief, based on ineffective assistance of counsel.

Gathering evidence and witness statements that support your claim is a critical first step. This could include documentation of any actions or inactions by your lawyer, the D.A., or the judge that you believe led to an unfair trial.

The timing of your actions is also important. Even though you've been released for a year, there may still be avenues to explore, depending on the specific laws and time limits in Missouri. It's essential to act promptly to ensure you don't miss any critical deadlines.

Consulting with a lawyer experienced in criminal defense and post-conviction proceedings is advisable. They can offer a detailed assessment of your case, guide you through the legal process, and help determine the best course of action.

Remember, each case is unique, so getting personalized legal advice is crucial. It’s important to be thorough and precise in presenting your case to your new legal representative.
