Haledon, NJ asked in Immigration Law for New Jersey

Q: I am reapplying F-2

My F-2 was previously denied due to concerns related to the legality of cousin marriage in the state my spouse was residing in at the time of application. It was a year ago. Now I am scheduling my visa interview date online but under "Visa priority" when i select previously refused, the calendar shows me available dates for year 2025. My spouse I-20 end date is June 2025. So in this context how can I request to expediate my interview date because its more than 6 months since my first rejection. Thank you.

A: To request an expedited interview for your F-2 visa after a previous refusal, you can follow these steps:

1. Contact the U.S. embassy or consulate where you plan to apply for your F-2 visa. Explain your situation, mentioning that your spouse's I-20 end date is June 2025 and that more than 6 months have passed since your previous refusal.

2. Request an expedited interview appointment due to the circumstances. Provide any relevant documentation that supports your case, such as your spouse's I-20, your marriage certificate, and proof that your marriage is legal in the state where your spouse currently resides.

3. If the embassy or consulate agrees to expedite your interview, they will provide you with further instructions on how to proceed with scheduling an earlier appointment.

4. In some cases, the embassy or consulate may require you to provide additional documentation or evidence to support your expedite request. Be prepared to submit any requested materials promptly.

5. If the embassy or consulate denies your request for an expedited interview, you may need to keep your current appointment or continue checking the online calendar for earlier available dates.

It's important to note that the decision to grant an expedited interview is at the discretion of the U.S. embassy or consulate, and they may have specific policies or procedures in place for such requests. Be sure to follow their instructions and provide all the necessary information to increase your chances of success.
