Enfield, NH asked in Divorce, Family Law, Child Custody and Child Support for Vermont

Q: Will a contempt filing from my ex be viewed as vindictive by the court?

My ex and I have gotten along for the last 12 years with minimal issues. Neither of us ever filed for modifications when there were changes in income (specifically, mine went up, she stopped working) or either of us had another child. A few years after the divorce I doubled what I paid her in child support, had my second child, and the insurance through my job lapsed, so my kid has had insurance through the state.

Recently, my job offered a good opportunity on the other side of the country and our 14 year old wants to go with me. The kid has been saying this from the start, but my ex is furious and already threatening to take me to court after mediation and file contempt against me over the insurance.

Will this be perceived as a vindictive filing as we have had no issues for the last 12 years? She has said in front of her partner and mine that she never "came after me" because I paid enough to support our child with.
