Q: Can a city(inspector) and a house builder be sued for negligence because of major flooding in a house for a failed grade

A city inspector in a conversation did a drive by did not get out of his car and passed the final grade. We then get sod installed and heavy rains came flooding our patio from underneath the patio and into our brand new house. The concrete patio is now structurally compromised and is starting to crack. The city inspector came to our house a second time end failed the grade for being too high near the patio and back of the house next to the brick. I talked with him for over 30 minutes and he first apologized profusely and informed me that the first approved inspection was performed from the seat of his car and from the NEXT STREET OVER(behind our house) The builder never once attempted to apologize however did dig a trench and added a pump for us to monitor and placed a dehumidifier in our home on last Friday late afternoon. Contacted my wife an hour later and informed her they couldn’t find the shop vac leaving the water damage inside the house for us to remove.
