Saint Charles, MO asked in Banking, Business Law, Civil Rights and Construction Law for Missouri

Q: I hired a non-licensed contractor to remodel. He did bad work and didn’t finish I put stop payment on second check.

I paid him 5000 after the Demo because he threatened to walk off if I didn’t give him a prepayment. He demanded another 5000 or he’d walk off midway through the job. I told him he had to finished doing most of the work before cashing check. He completed maybe 60% but 30% of the job was terrible. I told him it was unacceptable and he told me he would have his facilitator check it out and get back with me. I went to the job site and saw they were packing up. I asked where were they going and they said they were quitting the work. The contractor has not returned my calls or my text messages. His facilitator has not responded either. I put a stop payment on the check. My question is, Would I be responsible for the check if he cashed the check at one of those check cashing places? My bank said it hasn’t cleared. He may have cashed it there before I called my bank to stop the payment. I do have invoice listing the scope of work. I also wrote what was still incomplete and he signed it.
