Q: How can I find out who owned a particular LLC in New York as of October of 2007?

A: From the NYS DOS website:

The Department of State does not require or maintain information regarding the names and addresses of officers or directors of corporations, the members or managers of a limited liability company, the limited partners of a limited partnership or the partners in a limited liability partnership. These records are internal records maintained by the corporation, limited liability company, limited partnership or limited liability partnership.

The Department of State is able to provide the address to which the Secretary of State is required to forward copies of process accepted on behalf of a corporation, limited liability company, limited partnership and limited liability partnership, as well as the name and address of the registered agent, if one has been designated.

The name and address of the incorporator(s) of a corporation, organizer(s) of a limited liability company, general partner(s) of a limited partnership and partner(s) of a limited liability partnership, as well as the name and address of the filer of any document on file in the Division of Corporations, may be obtained at no charge through the examination of documents in person at our Albany office.

Since this information is not available on our Corporation and Business Entity Database, copies of any documents on file with the Department of State may be obtained by submitting a written request to the New York State Department of State, Division of Corporations, One Commerce Plaza, 99 Washington Avenue, Albany, NY 12231. The fee for a plain copy of any document is $5. A certified copy is $10

In othr words, if it is a New York LLC, you might be able to get a copy of its organizational certificate when it was formed, but that is no gaurantee it will ahve the information you want. If it is an out of state LLC, you will want to chcek withe the Secretary of State there.

If you are in litigation with teh LLC, you canask for that information in discovery. You will want to ask who the member, offivers and/or managers of the LLC were and are. "Members" are the people with ownership interest.
