Q: Can a wholesaler refuse to sell their products to a retailer?

We were looking for a beverage company. I have been talking with a company who in the begin'n gave me no indication that they would not sell us product. In fact, their rep stated that he would buy us a few cases of their energy drinks to help get us started. Their rep told me that he was still waiting on a cooler. I called again to see why it had not come when he said it would arrive and he stated that it would be another week or two. Although I was very upset because by this time we had done our Grand Opening, for which the cooler we supposed to be available for, and still had no soda waiting on the fulfillment of our order. I waited the two weeks and more so, I called the rep 12/09/10 and spoke with him again. After having dragged me along, stated that his bosses felt that the area that I was in was not a good area and that they were not going to sell us their products, if I am purchasing products to sell in my store, can a wholesaler just refuse me product?

A: Probably. It depends on the actual reason(s) they have for not selling products to you.
