A: If the person is being charged with a DWI, the officer is entitled to question the driver as to the circumstances of the charge, as long as the officer had probable cause to stop the vehicle to begin with. For example, if the officer stopped the vehicle due to speeding, an unsafe lane change, or disregarding a stop sign, the officer can then question the motorist and conduct an investigation, including requesting that the driver perform Field Sobriety Tests. Remember that a driver's license is a privilege, not a constitutional right. As to whether the information would hold up at a trial, the statements that the driver made can be used as an admission against the driver, and it would be up to a judge or jury to determine the validity of the statements if the case reaches trial.
