Q: I got a ticket for possesion of a small amount of marijuana in a baggie in kentucky and I live in indiana.

What kind of trouble am I in??

A: Possession of Marijuana is currently a class A misdemeanor in Kentucky. Class A misdemeanors are punishable by up to twelve months in jail and up to a $500 fine. Penalties this harsh are uncommon for this offense, however, and will depend upon the facts of your case. The amount of marijuana seized and your criminal record will both be very relevant when determining your sentence upon a plea or conviction.

You are not likely to serve active jail time for this charge unless you have a significant criminal record. You may also be eligible for diversion if this is your first offense. You should speak to a local attorney about the facts of your case.

It is also noteworthy to mention that HB 463, effective June 8, 2011, reclassifies the crime as a class B misdemeanor with a maximum of forty-five days incarceration.
