Q: I just got pulled over for a DWI. If I am found guilty, will I have to install an ignition interlock in my car?

A: Yes. Under New York's Leandra's Law, which went fully into effect last year, if you are convicted or plead guilty to a DWI, aggravated DWI or felony DWI, you are required as part of your sentence to install an ignition interlock device in your vehicle for one year. You will not be able to start your car, or keep it running once it is started, unless you are able to provide an alcohol free breath sample into this device. The only alcohol related conviction that you would not have to install the ignition interlock is for a DWAI (driving while ability impaired) which is a traffic infraction, not a crime.
