Orlando, FL asked in Child Custody for Florida

Q: My fiance works overseas in support of the military. He is now on leave and his ex-wife denied him the right to see his

Children. They have dual custody, and is currently paying 1900 a month in child support. He has also made a couple of attempts to speak with her and ask her for 5 days in June to see his kids while he is on his next vacation, and she refuses to speak to him. What can he do to stop her from denying him time with his children without having to go through all the expensive and time consuming court time? Your help would be greatly appreaciated. Can she get sanctioned for violated their divorce and custody agreement. Again, thank you for your time.

A: The Mother can be sanctioned if she is held in Willful Contempt of Court. There needs to be a Court Order which grants telephonic communication and holiday visitation. If she then intentionally fails to comply, then sanctions such as makeup visitation and attorney's fees may be imposed.
