Q: I have a lawyer who is not doing his job, What should I do?

I had a slip and fall acident in a store, in had to have knee surgery and right wrist problems. its been more than two years and my lawyer said they offered 5000$. what should I do?

A: Before you can conclude the lawyer is not doing his job, you need to know what work he or she has or has not done. For instance, since the incident is over two years old, a lawsuit should have been filed and served on the responsible party if the claim arose in Georgia. Otherwise, your claim is lost. In Georgia, you generally only have two years to file suit. I would ask the attorney if a lawsuit has been filed and served. If a lawsuit has been filed, the next step is to litigate the claim. This involves sending out interrogatories, requests for documents and taking the depositions of the responsible company or persons and witnesses. Slip and Fall cases often have to be litigated through a motion for summary judgment (ie: motion to dismiss), before any substantial money is offered on the matters. I am glad to speak with you about the matter, but will encourage you to speak with your current counsel to determine what has or has not been done. If you remain dissatisfied, you can change counsel if you wish.
