Q: Am I doomed to just receive the minimal distrubution from trustee?

I went to file a summons & complaint on a bad debt of which part of the asking money was paid with a NSF check. This happened on the same day that the defendants filed a Chapter 13 Bankruptcy. The next day I received a Notice, Chapter 13 Plan, Motions to Value Security, Avoid Judicial lien, avoid a nonpurchase money, etc...I do not want to object to this and go out of town to the hearing but I don't want to just fill out a proof of claim either & consider this an unsecurd debt giving me pennies on the dollar (if that)...Any suggestions; the check is eight months old.

A: I would strongly suggest you meet with an Experenced Bankruptcy Attorney, with Creditor Experence. A NSF Check is FRAUD, if properly handled should not be avoided, and you could force payment.
