Q: Q: Does pretrial services evaluate for mental illness/brain injury? What should be completed before the prelim hearing?

Is pretrial services required to complete the evaluation prior to prelim hearing?

A: Generally, state and/or federal, pretrial services does a brief background review and prepares a report for the parties and court before the initial court appearance to assist the court in deciding if pretrial release is appropriate. Typically they will not do further investigation, for example related to mental illness, unless requested by the court or the issue otherwise becomes a focus point of the pretrial release hearings. So other than listing general information about someones mental health status, "generally" the report goes no further.
