A: "Theft" under Section 31.03 of the Texas Penal Code is a Class A misdemeanor if the value of the property stolen is $500 or more but less than $1,500. An individual adjudged guilty of a Class A misdemeanor shall be punished by:(1) a fine not to exceed $4,000; (2) confinement in jail for a term not to exceed one year; or (3) both such fine and confinement. If on the trial of a Class A misdemeanor, the defendant has been previously convicted of a Class A misdemeanor, or any degree of felony, upon conviction, the minimum term of confinement cannot be less than 90 days.
