A: I understand your situation to be the following: your brother had "guardianship" of your boys but has left the state of indiana leaving the boys in the state with someone else. it is unclear whether a formal guardianship was established through the courts. if so, that particular court would have jurisdiction to establish another guardian over the boys. there are alot of unanswered questions such as where is the mom, who has the boys now, etc.. bottom line is that you need to get a lawyer who does domestic relations law in the county where the boys are located. if it is lake co, our firm's adam sedia or nicole keith could answer any further questions. feel free to call either of them.
