Q: Case law changing theft/dealing stolen prop. into a civil matter? (FL)

My sister in law sold prop. belonging to me, was stored on their prop.(which is in my brother's name & he stands by me),I filed charges and she was arrested. The state att. told me that her att. is supposed to be showing him case law that will show this is a civil suit instead of criminal. Can you tell me what this could be? I'm so frustrated because it seems victims do not have as many rights as the defendants. Also, I told the police where my prop. was, showed them receipts for purchase, but they refuse to pick it up, saying that because there is no serial #, the person in possession of it can say it was theirs - and they do not have to show proof. They said they sold it, and do not have to say who they sold it to, but we know it was not sold and is sitting on their prop. Right now the justice system is really letting me down and I have no where to turn, but if civil, I will pursue it because I refuse to let her get away with this! Thanks for your help!
