Q: How will i know if someone who files bankruptcy has listed me on their list?

A: The US Bankruptcy Court Clerk receives a 'mailing matrix' of creditors from the debtor or his attorney. The Clerk will then mail a Notice of Bankruptcy filing to you.

If you are concerned that someone who owes you money has filed for bankruptcy and listed you as a creditor, you can check for free by visiting the Clerk's Office and viewing the file. Sometimes debtors will give the Clerk an incorrect or outdated address for you, and you won't get notice.

If the person has filed for bankruptcy without notifying you, you will probably want to file a Proof of Claim with the court. This is usually the first step to protecting your rights to a share of the bankruptcy estate.
