Asked in Immigration Law for New Jersey

Q: My friend got conditional green card just two months before 2nd aniversay of her marriage with US citizen.

My friend got her conditional green card just before two months of completion of their 2nd anniversay. she is living in US from last 6 months with her husband. she is more young and pretty than her husband. she is highly qualified. but unfortunately her husband keep her in the house and dont allow her for job. Most of the time her husband keep her in his car in the parking during his office timings even for 8 hours. even if she is sick . her husband says that if she will resist not obeying him,she will be deported after 2 years on expiry of her green card. she is getting mentaly tortured but she cant go back because she lost her job and sold all property in her own country. Can she apply for I-751 to remove conditions. she is in marriage relationship from last 2 and half years but got green card just before 7 months. please give her suitable advise. she is in terrible condition.

A: This certainly sounds like a terrible situation. She may be eligible to remove the conditions on her green card through a waiver, but there are certain requirements as well as certain proofs that must be demonstrated. She should definitely consult with an immigration attorney.
