Q: My lawyer refuses to release a medical expert report to a company that I am seeking a settlement advance with.
I have a major medic al malpriactice suit. And am in need financially. My lawyers father (senior partner) was willing to consider it but He refuses. The original contract stated that they do not support these loans but I made a request based on humanitarian needs. They have agreed to release only the original complaint. Do i have any recourse?
A: I can understand why your attorney is reluctant to communicate with the funding company. Have you asked your attorney what his concerns are? There may be ethical concern on the part of your attorney. I assume your attorney has provided you with a copy of the expert's report. Why don't you send a copy to the funding company yourself?
