Q: CANCER – Is a personal charitable fundraiser legal in Florida?

Good Morning,

After months of tests and surgery at Moffitt Cancer Center in Tampa, the doctors concluded that my wife has inoperable (terminal) cancer. We cannot accept this response therefore we have explored alternative methods to resolve this issue. After extensive research we found Utopia Wellness Center in Oldsmar Florida. Although their fees are minimal compared to Moffitt we still do not have twenty thousand dollars to pay for their services.

Several people have suggested a fundraiser to cover these expenses. In fact, yesterday one our friends told my wife that she would be the first to donate one thousand dollars to the cause. Therefore, on Monday they plan to open a new bank account so they can deposit the one thousand dollar check. It’s amazing how many people want to help us fight this dreadful cancer.

My question to you is, can we simply go to the bank and open an account or is there some legal Florida formality that we have to follow?

A: My opinion is that you have to start a non-profit organization.
