Q: I have received a judgement in small claims court have to write order for judge to sign for garnishment. Can you advise

A: There is a specific procedure that must be utilized when garnishing wages or a bank account. If you do not do it correctly you will not get anything. Look at the garnishment statutes in Chapter 77 of Florida Statutes and also those in Chapter 222 regarding exemptions. You should hire an attorney to get this done right. If the person you are trying to garnish wages from is the head of a family in Florida, there is no sense in paying all of the costs to garnish, you will lose. Also if the target is a bank account which contains nothing but the wages of a head of family, you can easily waste the money. At least consult with a collections attorney in your area and find out what can and cannot be done, and what must be done.
