Q: I took a plea deal a Felony that was reduced to a misdemeanor after 2yrs probation. Am I considered a convicted felon?

In 2009 I accepted a plea deal for a Felony Reckless Discharge of a Firearm within a Municipality. The condition was that it would be reduced to a misdemeanor upon two years of probation, which it was. The MN BCA always showed the conviction as a gross misdemeanor. as it still does. Am I considered a convicted felon?

A: Provided you successfully completed probation you are not a convicted felon. There seems to be a frequent problem of the BCA records not being accurate in these circumstances. I would try by writing the BCA a letter and include the relevant court records to show that it is a misdemeanor conviction.
