Alexandria, VA asked in Immigration Law for Virginia

Q: I never got my I-94 when I entered the U.S should I file for the I-94 first or at the same time as the I-130 & I-485?

I've been married for almost a year and I want to start filing for residency and eventually my citizenship but I never received myI-94 so I don't know if its best for me to file for the I-94 before filing for the rest of the forms or doing everything at the same time. I'm hearing things from people and I don't know who to listen to. Thank you.

A: You must show proof of your legal entry when you appear for your adjustment of status interview. Do you have a stamp in your passport showing legal entry? You should file for replacement I-94 to show proof of legal entry.
