Q: Ex filed bankruptcy after divorce Decree say I am responsible for mortgage ex incl mortg in his debts.loan in bankruptc

If I am responsible for the mortgage. stated in divorce decree, although I am not on the note, how can he do this when it says I am to take over debts? I've been trying to get an assumption on the loan to my name. Quick claim deed filed. House is in my name. Isn't it fraud that he included the payments even though he hasn't made any since final divorce in February? I've been waiting for the loan company to get the loan in my name, to no avail. Back & Forth. I have not made payments either. as I don't want to in his name. Very confusing situation, but loan co. told me that the loan is in bankruptcy. I want to keep home, and make payments, and have the loan rescinded from his bankruptcy. He did not have enough debts to have filed, if he did not include the loan too. Court date was last month, and apparently he got it. Loan Co. has my info, divorce papers, etc., but ingnored it I was told they were going to file an objection to not include them, but they didn't.

A: This is a mess, and you apparently do not know what to do. The best thing to do is speak with an attorney about this. It might be too late, because you have not paid on the mortgage. An assumption is about the only way you can go at this stage, and those are not common anymore.
