Florida, FL asked in Insurance Bad Faith for Florida

Q: Person living in and taking care of house stole and 'inadvertently threw away' lots of valuables. Do I have recourse?

*Man contracted to live in house and take care of it.

*I arrived to find a lot missing (copper samovar and small copper items, silver punchbowl and large candlestick, brass portholes).

*Police interviewed him and he told them he had "inadvertently" thrown items away.

*Police say there is no record of him scrapping them in local town. They cannot locate any of the items and say that because he admits throwing them away it becomes a civil matter.

*My insurance will not pay because it is not 'theft' according to police.

*The man does not have much income, so does it do me any good to file in small claims court? Should I sue my insurance company?!
