Birmingham, AL asked in Animal / Dog Law for Alabama

Q: Help keeping our much loved pet

I have been delivered a civil petition for Injunctive Relief, claiming that a dog that lives in my house has violated the protective covenants of dangerous activities and may be or become an annoyance or nuisance to other property owners in the subdivision. Allegations that she has "attacked" at least on three occasions. They are asking that she be removed from our home since an incidence in Oct. of 2013 when the dog was let out into the fenced back yard, got out of the fence and "bit" a woman walking in the neighborhood. I called the woman and offered assistance, volunterrelly took her to the vet for obversation for 10 days and exam. She was given a good health record and "great pet" by the vet. The dog has not been seen by anyone in the neighborhood since, as I only allow her out on a short leash with me in the privacy of our back yard, take her to the park and out on leash in the dark.

A: Sounds like you've got a law suit on your hands. Sounds like the local municipality or your subdivision Property Owners Association is suing you. Just like any other dispute, there are two sides (at least) to every law suit. You will have your opportunity to give your side of the case at an appropriate time. In order to give yourself the best chance of presenting your case, you need a lawyer. Hire one pretty quickly. You only have a little time within which to answer this complaint, if that's what this is.
