Q: I have a dyfs case because my son said I punched him giving him a black eye which isnt true the judge said that all
parties have to be in agreement for my children to be returned home. cpc report finds no evidence of abuse and all other parties are in agreement excepty childs law guardian who is trying to stick with the lie he told. my question is can will it hold up in court with the judge if so under what circumstances?
A: The Judge will give substantial weight to what the child's law guardian says and can prove. You need to retain counsel and have an expert involved to support your position. Good luck.
