Q: How do I get my parents (Calif) be declared legally incompetent? A court ordered evaluation?

My mom's had a bad stroke, my father has Alzheimer's and we (their kids) are trying to amend their trust so that one of us can get signatory powers for their checking account

A: It is likely that you will need to have yourself or one of your siblings appointed conservator of the person and of the estate. This will permit the conservator to make both medical and financial choices for your parents. The probate court will decide whether to grant the petition to appoint a conservator (typically after a rather short proceeding).
