Q: If i dont have custody can i get in trouble if i dont take my son back to his care givers at this time
My son who is 4 years old is in transition to come back to live with me he doent want to leave when he is with me
A: It doesn't matter what your son wants at this point. Follow the court order. It will harm your position, and possibly the transition schedule if you don't follow the schedule.
A: It depends on a lot of factors. Such as, is there a Court Order in place? If so, what does the Court Order say? If there is no Court Order in place, you and the other parent have equal rights to the child, and if the police were called they would not be able to get involved, unless their evidence that the child is in harm. However, by preventing the other parent from seeing the other child can have a long term negative effect on a custody arrangement for you, if your matter ultimately goes to Court (unless of course you can prove that the child is being harmed in the other parent's care).
