Q: Can I still get child support if I make more than the father?

The father is currently unemployed but has gotten a new job that starts soon. He still will not be making as much money as I am. I have our son. Is he still required to pay child support or would I pay him? even though I have our child?

A: Depending on what the custody arrangement you have and what income he has (perhaps by also imputing income as well), will determine what, if any, child support either of you owe. There are child support guidelines (and worksheets) used by the Court that most family law attorneys have access to. Consult an attorney who can help you determine possible outcomes. If it is only child support (meaning there is already a written agreement or order in place regarding custody) then contact OCSE who can file child support action for a fee of $25.
