Q: I have full custody of my child the father has visitation He has not visited her for 9 months has he forfeited his right
He has not paid child support in 6 months. He told me in march to no longer contact him. Can I have his parental rights completely removed so I can do things like get a passport for her go on vacations etc.
A: You can file for a Modification of Custody to seek sole legal and physical custody. If granted you then will be able to do things such as get a passport for her to go on vacation, etc (although it is likely that you are able to do those things now, but I nor any other attorney could confirm that without reviewing the court order entered that set forth the custody arrangement between you and the father). If the father has stated he does not want contact with the child, perhaps he would be willing to sign an Custody Agreement provided you with sole legal and physical custody. This would move the court process along a lot quicker. By having sole legal and physical custody you are free to care for your child as you deem to be in the child's best interest and the father would still be obligated to provided child support to you for the benefit of the child.
