Q: Overstayed by accident.
My parents (both citizens of India) hold a 10 year multiple entry visitor visa to the US which is valid till 2016. They have visited me here in Colorado 3 times in the past (2006, 2007 and 2010). When they visited the last time (2010), the person at the immigration counter stamped my father's passport with a date that was 3 months after their return ticket and stamped my mother's passport 10 days before their set departure date. We did not notice the difference until the day before they were scheduled to return. As a result, my mother ended up over staying by about 10 days or so. They did send a letter to the US consulate in India explaining the situation upon their return and were assured that this would not cause any issues on any future trips to the US for my mother. My parents are scheduled to visit me again this summer. Should I be concerned? They plan on staying here for 3 months and their return ticket is already booked.
A: Seek for opinions from an experienced immigration attorney. Good luck. www.aba-us.com
