Q: Mississippi:I refused to lower my window more than 5 inches. Arrested for failure to comply. Any defense?
I was parked engine off with a female friend. Police officer pulls up behind us and approaches the car. I put my window down 4 to 5 inches. We are in a very dark area no traffic so communication is not at all effected. He questions why I won't put the window down. I just say for my safety. Doors are locked also. He gets aggitated as he runs my license. He comes back madder and tries to open my door. At this point he goes into a rant about not knowing who I am and I could be lying to him or have a gun in the car. I have the interior lights on and hands on the wheel. I tell him there is nothing illegal in the car and also no gun. I proceed to tell him if he suspects something he can tell me what he suspects is illegal and we will discuss options. More officers arrive and they ask the same questions. The very angry officer again tells me to put the window all the way down. I tell him I will put the window all the way down if he can quote me the Mississippi statute requiring me to do so.
A: Surely, the cops have written a completely different story. You need to get a private criminal defense attorney locally to investigate all the facts and circumstances and do research into this particular topic.
