A: The answer to this question depends on his record, whether you were injured, the personality of the judge and prosecutor, his prior history, his demeanor in court, whether he accepts responsibility, etc. etc. DV can be charged as anything from an M1 to an F3 depending upon history and circumstances and can carry mandatory minimums if the vicitm was pregnant. In other words, there isn't nearly enough information here to answer your question. Has he even been convicted yet? You just say the state picked up the case.
