West Tehama County, CA asked in Wrongful Death for California

Q: Can you sue a ambulance company if the driver says protocol is one way and agency says protocols is the another way

Mom fell in minimal pain. Ambulance refused to take us to the hospital we wanted they said protocol is to take you to nearest hospital. Emailed the agency that writes their protocols and they said it is the patients choice to go where they want unless it's life threating . In result they refused us to go where my mom wanted. The hospital the ambulance took mom to is also questionable for negligence to for turning a fall into a critical condition situation and patient dying. Can we hold ambulance service part responsible for lying about what their protocol is and going against it.Thanks

A: I'm sorry for your loss. Best to talk to a CA injury lawyer ASAP who is familiar with medical negligence cases. They can sort through the details and help you determine if there is a viable claim. Don't delay, as there are strict deadlines for making legal claims, and it takes time to investigate and prepare this type of case.
