Q: Employer suing ex-employee for not providing continual support after employee quitted. Does the company has a case?
I was hired as a programmer in a 2 people company (me and owner). After working for a long time, I was given the title of CTO. However, I was not given a new contract or any documentation detailing my role and responsiblities as CTO. Basically my daily job activities did not change. From time to time, other people were hired into the company, but they did not report to me. The company did not do well and for more than 6 months, I did not get paid. Eventually, the reality kicked in and I had to quit and take up another job because I needed an income. I did not leave in good terms as the company would not pay me the owed salary, and demanded me to provide continual support them on contingent (ie, pay me in the future if they manage to earn money), which I refused to accept. Now the company is considering suing me for not providing them continued support in order to seek damages. Does the company has a case? What options do I have?
