Asked in Criminal Law for Oregon

Q: Charged with Criminal Trespassing II in Oregon. Am I guilty?

The property is an old school that was recently fenced in for reconstruction. Owned by the city of Redmond, Oregon. I was on the property reading a book. A woman came out and asked me to leave. I assume she is an employee of the city council as they are in charge of the reconstruction. I told her That I wouldn't leave because there are no "no trespassing signs" and this is city property. She said she would call the police and I told her I would wait and speak with them to determine what to do next. They arrived. I explained the situation and charged with the misdemeanor.

Am I guilty of this charge? Do I have a case? Or should I bite the bullet and pay the $1000 fine that is sure to really help me out!

A: What you ask is not just for basic legal advice. In order to fully answer you an attorney must know all of the facts, not just your version. There are at least two other versions which will be in the witness statement and the police report of this incident. Those thing must be known as well as the statute and case law on this specific topic.
