Columbus, OH asked in Civil Litigation for Ohio

Q: Case law where the architect of a baseless cease & desist letter is liable for the legal fees of the letter receiver

I received a baseless cease and desist letter. They want to do a settlement agreement (after realizing they had no case) but are unwilling to make me whole in regards to the legal fees and time i spent in defending these baseless accusations. Their attorney is saying that there is no law or case-law that indicates his clients owe me anything.

Thank you for the message you sent to my question - i was trying to assist in some research of case law. Yes i do have an attorney working on this, but after my attorney has proven the claims were baseless which cost me several thousand dollars, i want to limit future attorney work (expenses) which is billed at over $300 per hour. This is a website provided for people to ask questions. Your answer was a waste of time. Do you think i didn't have this discussion with my attorney? Sure, they will do research...... Go find something else better to do then criticize someone for asking a question when that is the purpose of the website... I would appreciate if you can remove that answer so people don't see what an ass you are for responding in the manner that you did.... Are you really an attorney???
