Q: Should I fight this?
I saw a red light coming up and began to slow down, I am pretty sure I was driving 50 mph. There was a car in front of me and I was driving at the same pace as him. Before the stoplight there's a bridge (high-way above) and the cop happened to be sitting on his motorcycle between the pillars. I didn't see him until I was about 50-100 feet away. When he pulled me over he asked me for my license, which I didn't bring. He ended up only citing me for being 10-19 mph over the speed limit and ending up with 4 points. Now, while I'm thankful for him not adding the fact that I didn't have my license to the ticket, I'm very confused why he pulled me over rather than the car in front of me. And why would he be checking my speed first, rather than the other car? -- Is there a way to just pay the ticket and take a traffic school course? Would that eliminate it making my insurance go up? I got into an accident about a month ago.
A: You can challenge this arguing that the speed was reasonable for the circumstances. Your chances improve if the event occurred in clear weather and the lower your speed was over the limit. The chance of success is hard to say, it is up to a judge. If you want it eliminated you can plea and go to traffic classes. This can be several hundred dollars, but will clean your record.
