Hackensack, NJ asked in Landlord - Tenant for New Jersey

Q: Can I be charged double rent for my Apartmrnt during my Lease term even if I am paying my rent on time

I have leased an apartment from Sep 2015 to Aug 2016. I wanted to break the lease. and I know I will be responsible for rent till my lease end or some one re-rent it. I gave 60 days notice to vacate on Oct 28, 2015. My plan is if someone come to rent it I will vacate by Dec 28, 2015. Otherwise I will continue to stay.

My Apartment office sent me a notice saying I need to vacate by that date even if no one rented it. I am still responsible for rent till end of my lease term which is Aug 2016. If I dont vacate the unit they can say it "HoldOver and ask me to pay double rent.

Why shouldn't I continue to stay till my lease end, If no one re-rent it?

Thanks

Kumar
