Q: My mom is falsely being accused of assault and harassment?

My cousin has falsely accused my mom of assault and harassment. She claimed that my mom attacked her at her home and is harassing her over text and facebook. My mom has done none of these things and wasn't even home when my cousin claimed she was attacked. My cousin made a police report, used false "witnesses" and created marks on her body and said that my mom was the one that did it. Today we received a letter in the ail saying that my mom could go to jail for 365 days. Obviously my mom is innocent but how do we prove that. 7 years ago my cousin took my mom to court over harassment but my mom was found innocent because there wasn't any proof and my cousin didnt show up to court. Im really worried that my mom will be found guilty of something she did not do.

A: Your mom needs to get a private criminal defense attorney locally to represent her. She does not have to prove one single fact. The state must prove her guilt beyond a reasonable doubt. From what you have written there is plenty of reasonable doubt here.
