Little Rock, AR asked in Personal Injury for Arkansas

Q: Can we sue someone for lying causing stress if there is proof?

My husband nudged my sister's car and when he texted her saying he wanted to fix it, she said to not stress and worry about it. There are scratches we aren't sure he even did and there is a tiny 3mm chip taken off. Chris offered to atleast pay with lunch and she agreed. A week later she texts him saying my mom accidentally saw the picture and now she's going to get an estimate. She also doesn't want him to tell me.

A: Where is the proof? There is not a cause of action for lying that I know of. What are the damages? The stress? Go have a full discussion with an attorney. There might be a cause of action for intentional infliction of emotional distress available.
