Q: I am seeking advice on how to go forward with a suit for professional sexual misconduct by a drug counselor in a halfway

A: Sexual misconduct by a staff member at a halfway house or other type of treatment facility should not occur. In order to have a case against the facility, you will need to show that the facility knew or should have know of the behavior of this individual. For example, if the individual had acted similarly with other residents and the facility failed to take any intervention, such a situation would likely be deemed actual notice of the behavior. In other situations, perpetrators may have a record of similar incidents at other facilities. If the facility failed to conduct an adequate background search, they may also be exposing themselves to civil damages. You should consult with an attorney who can better address the circumstances in your case.
