Q: Speeding ticket questions; Can I fight this? Help; or is it to late?
I recently got a speeding ticket back in sept. 28 in state of South Carolina, i was coming back from ATL. I am from VA; I recently got my license back from my first suspension and i serve the first three months. So when I got it back, i JUST Got my license; My DMV record earlier show I had -7 pts before I got the speeding ticket in South carolina; the state trooper told me that if i paid the ticket before the court date issued; it would of drop from a 4 pt dermit pt to a 2 pt. I just recently look at my driving record and it shows DMV VA posted -4 demerit pts on my record so now I have -11 pts. Can I fight this or is this different? I was speeding 79/60; question is can i fight this? i still have copy of the ticket on my computer when I paid it off; What are the rules for driving out of state and your from VA? I got this speeding ticket while i was on my 6 month driving probation, DMV records says my suspension will be effective on Jan 2. 2016-Mar 1 2016. Can I fight this against DMV?
A: It sounds like your first step would be to consult with an attorney in South Carolina to see what you can do regarding the ticket you received in South Carolina. From what you describe, it sounds like DMV in Virginia is merely taking action on what was reported to them from South Carolina. Virginia DMV would not have any authority to change or modify what happened in South Carolina.
