Gladstone, NJ asked in Collections for New Jersey

Q: Can I file a motion to vacate a judgement that is about 2 1/2 years old in New Jersey?

The original amount owed was 16,00.00 and the final judgement was then 28,000.00 and I had made payment arrangements. Since my husband has not been able to work for about a year now I was not able to keep up with the payments. The are now trying to garnish my pay and the amount they are looking for is about 43,000.00. I have been checking the state laws and I think they charged me 77.7% interest on the first judgement. Is that grounds for vacating the judgement? My financial situation has also changed. My husband has had to apply for SSI Disability.

A: No, not after so much time has elapsed. To properly answer your questions and address your concerns, the best way to handle this is with an in person consultation with an experienced Bankruptcy attorney. Good luck.
